About the Services
SendRoq provides a cloud-based software platform designed to automate and manage professional outreach workflows, including integrations with third-party platforms such as LinkedIn. The Services are intended for business and professional use only. You represent that you are at least 18 years old and have the authority to enter into this agreement on behalf of yourself or your organization.
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep such information updated. We reserve the right to suspend or terminate accounts that contain false, misleading, or incomplete information.
Compliance with Laws & Platform Policies
By using SendRoq, you agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. You further agree to comply with all applicable third-party platform rules, including the terms and policies of LinkedIn. SendRoq does not guarantee compliance with such third-party terms, and you acknowledge that you use the Services at your own risk.
Prohibited Uses
You agree not to use SendRoq for any unlawful, harmful, or abusive activities, including but not limited to sending spam, phishing messages, fraudulent communications, or unsolicited bulk outreach without a lawful basis. You must ensure that all outreach conducted through SendRoq complies with applicable anti-spam laws and respects user consent and opt-out preferences. You are solely responsible for any data you upload, process, or transmit through the platform.
Platform Use & Monitoring
SendRoq operates as a technology provider and does not control the content of user campaigns or communications. You retain full responsibility for your outreach activities, including ensuring compliance with applicable laws and platform guidelines. We reserve the right to monitor usage patterns and restrict, rate-limit, or suspend accounts that exhibit suspicious, abusive, or non-compliant behavior, including excessive automation, abnormal activity levels, or actions that may pose risk to third-party platforms.
Third-Party Integrations
The Services may include integrations, APIs, or connections to third-party platforms and services. You acknowledge that such integrations are provided for convenience and are subject to the terms and policies of the respective third parties. SendRoq does not control and is not responsible for the availability, functionality, or changes made by such third-party services. We shall not be liable for any disruptions, data loss, account restrictions, or damages arising from your use of third-party integrations, including LinkedIn.
Beta Features
SendRoq may offer access to beta features, experimental tools, or early access functionalities. Such features are provided "as is" without any warranties and may be modified or discontinued at any time without notice. We are not liable for any issues arising from the use of such features.
Billing & Payments
The Services are provided on a subscription basis. By purchasing a subscription, you agree to pay all applicable fees as specified at the time of purchase. Unless otherwise stated, all fees are non-refundable. We may offer refunds at our sole discretion in exceptional cases. We reserve the right to modify pricing, introduce new charges, or change billing structures at any time, with reasonable notice where required. Failure to make timely payments may result in suspension or termination of your account.
Intellectual Property
All intellectual property rights in and to the SendRoq platform, including software, design, trademarks, and content, are owned by SendRoq or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services solely for their intended purpose. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Services.
Indemnification
You agree to indemnify, defend, and hold harmless SendRoq, its founders, employees, affiliates, and partners from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to your use of the Services, your violation of these Terms, your infringement of any rights of a third party, or your failure to comply with applicable laws or platform policies, including those of LinkedIn.
Limitation of Liability
To the maximum extent permitted by law, SendRoq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, loss of business opportunities, or data loss arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount paid by you to SendRoq for the Services in the twelve (12) months preceding the event giving rise to the claim.
Disclaimer of Warranties
SendRoq provides its Services on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, secure, error-free, or compliant with the requirements of any third-party platform, including LinkedIn.
LinkedIn Disclaimer
SendRoq is an independent software platform and is not affiliated with, endorsed by, or sponsored by LinkedIn. You acknowledge that the use of automation tools may violate LinkedIn's Terms of Service and may result in account restrictions, temporary limitations, or permanent suspension. SendRoq shall not be liable for any consequences arising from your use of the Services in violation of third-party platform policies.
Termination
We reserve the right to suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe that you have violated these Terms, engaged in harmful conduct, or created risk for the platform, other users, or third-party services.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
